Terms of Service

These Terms govern your use of the Effimera app and website (the "Service"), provided by [Effimera / Legal Entity], based at [address] ("we", "Effimera"). Please read them carefully: they are written plainly, but they are a binding agreement.

1. Acceptance

By using the Service you accept these Terms. If you do not accept them, do not use the Service.

2. What Effimera is

Effimera is an ephemeral, geolocated, mostly-anonymous social map. You leave an emoji mark (a "Geoemoji", struck into a coin called a "Gettone") tied to a place. Every mark is ephemeral: it lives about two hours and then fades. There are no permanent profiles and no feed.

3. Who can use it

You must be at least 16 years old. By using the Service you confirm that you are.

4. Your content

The content you post (emoji, short text, optional photos) stays yours. To make it work in the Service, you grant us a limited, non-exclusive, royalty-free license to host, display and distribute that content — only for as long as the mark is active, and only to operate the Service. The license ends when the mark fades or is removed.

You are responsible for what you post and confirm you have the right to post it.

5. Acceptable use

You may not use the Service to post or do things that are:

• illegal or that infringe someone else's rights;
• hateful, discriminatory, violent or that incite hatred;
• harassing, threatening or bullying toward a person;
• exposing others' private data (addresses, contacts, images without consent);
• spam, unsolicited advertising, or automated manipulation of the Service.

You may not try to bypass technical limits, overload the systems, or compromise the security of the Service.

6. Moderation and reporting

You can report content you find inappropriate by writing to [contact email — e.g. abuse@effimera.app]. We may remove content or restrict access when it breaks these Terms or the law. Because marks are ephemeral, many disappear on their own within a short time.

7. Intellectual property

The app, the website, the "Effimera" brand, the "Gettone" concept and name, the software and the design belong to [Effimera / Legal Entity] or its licensors. These Terms give you no rights over them, other than permission to use the Service as intended.

8. "As is" service

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranty that it will always be available, error-free, or fit for a particular purpose. Marks are temporary by nature, and we do not guarantee that content will be preserved.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect or incidental damages, or for the loss of ephemeral content. Nothing in these Terms excludes liability that the law does not allow us to exclude, including consumer rights.

10. Changes to the Service and the Terms

We may change, suspend or discontinue parts of the Service. We may update these Terms: we will post the updated version with a new date. If you keep using the Service after changes, you accept them.

11. Termination

You can stop using the Service at any time. We may suspend or close access if these Terms or the law are broken.

12. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute falls under the courts of [competent court — e.g. Rome], without prejudice to mandatory consumer rights.
